CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR TO WIN. CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA. ENTRANTS MUST AT LEAST BE TWENTY ONE (21) YEARS OF AGE AT TIME OF ENTRY. VOID WHERE PROHIBITED.
1. Sponsor: Ageless-North Shore, a division of Don Shearn Marketing Services LLC, 1256 Forest Ave., Highland Park,IL 60035 and Coupon Group, LLC d/b/a The Got Spot, 2907 Arlington Avenue, Highland Park, IL 60035 (the “Sponsors”).
2. How to Enter: You must enter between December 4 and December 31 at 11:59 P.M. Central Daylight Time (“CDT”) (“Entry Period”). To enter the Contest, submit your entry during the Entry Period, which must include your resolution and a reason why you must make the change on www.ageless-northshore.com (the “Site”). Submit the entry along with your name, address, telephone number (including area code) and email address if you have one (collectively, your “Entry”). (Please note that all entrants must be at least 21 years of age).
There are two methods of entry:
Method #1: Send your Entry to Ageless-North Shore, attn: Don Shearn, 1256 Forest Ave., Highland Park, IL 60035 (Mail-in Entry(ies)”).
Method #2: Submit your Entry by e-mail. Ageless.NorthShore@gmail.com (“Online Entry(ies)”). All entries become the property of Sponsors and will not be acknowledged or returned. Sponsors are not responsible for lost, late, illegible, incomplete, misdirected, postage due, mutilated/damaged entries or electronic entries which are not in required format. Mail in Entries must be postmarked by 11:59 CDT on Monday, December 28, 2009 and received by Wednesday, December 30, 2009. Online Entries must be received by 11:59 PM CDT on December 31. Limit one entry for each Nominee during the Entry period. Multiple Entries submitted for the same Nominee shall be void. Incomplete Entries shall be void. Mail-in Entries will be transcribed and entered online for voting purposes.
3. Eligibility. The Contest is open only to legal residents of the 50 United States or the District of Columbia who are at least twenty one (21) years of age at the date of entry. The Contest is not open to employees of Ageless-North Shore or The Got Spot and each of their respective affiliates, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees.
4. Eligible Entries: All Entries must be the original creation of the entrant and must not have been previously published. By submitting an Entry or accepting any prize, entrant represents and warrants that the entries submitted by the entrant are the original creation of the entrant, have not been copied in whole or in part from any other work, do not violate or infringe any copyright or trademark or other proprietary right of any other person or entity and are the sole property of the entrant. Any person featured in any entry must have provided his/her consent to entrant for the submission in this Contest. Submissions that include information about a child who is less than 13 years of age will not be considered for this contest. Entrant represents and warrants that he or she has full legal right, title and capacity to submit the entry submitted to Sponsors and that Sponsors have full and unfettered right to use, copy adapt and publish same in any and all media for any purpose whatsoever. Entrants agree to indemnify and hold harmless Sponsors and their affiliates and agencies for any action brought by a person whose consent was not obtained by the entrant. Submitted Entries will not be acknowledged or returned.
5. Judging Criterion: Entries will be judged on how compelling the desire is to keep the resolution. In the event of a tie, a random drawing will be held of those entries that the judges deemed most compelling. Judges decisions are final.
6. Prizes: Sponsors will engage professionals in the appropriate field to help the winner keep his or her resolution. Winning the contest does not guarantee a resolution will be kept, nor does it guarantee which professionals will be engaged to help the winner. Upon acceptance of the prize, the winner agrees to be followed by the Sponsors for the year 2010 by keeping or contributing to a blog on ageless-northshore.com, by allowing ageless-northshore.com to video both professional consultations and every day life each month for publication on ageless-northsore.com.
7. Winner Notification: The winner will be notified by e-mail, phone or both at the discretion of the Sponsors within the week following the conclusion of the voting. The return of a prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Winners are solely responsible for reporting and payment of all federal, state and local taxes on prizes. Winners will be required to execute and return within fourteen (14) days of notification an affidavit of eligibility, a liability release and a publicity release (collectively “Release”), except where prohibited by law. Failure to sign and return the Release within fourteen (14) days, or to comply with any term or condition of these Official Rules or the prize notification letter will result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner.
8. Waiver: All winners by participation in this Contest and acceptance of a prize, agree to release Ageless-North Shore and Coupon Group, LLC and each of their respective parent companies, divisions, affiliates, subsidiaries, distributors, suppliers and advertising, promotional or judging agencies, and their respective employees, officers, directors, agents and legal advisors from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the entrant’s participation in the Contest or the entrant’s acceptance, receipt, ownership or use/misuse of the prize, including, without limitation, personal injuries, death and property damage and claims based on publicity rights, defamation or invasion of privacy. Sponsors make no representations or warranties of any kind concerning the prize awarded. Each entrant agrees that Sponsors and each of its respective parent companies, divisions, affiliates, subsidiaries, distributors, suppliers and advertising, promotional or judging agencies, and their respective employees, officers, directors, agents and legal advisors shall not be liable or responsible for any printing or typographical errors in any materials associated with the Contest. The winner shall bear all risk of loss of prize after it has been delivered. Except where prohibited by law, participation in the Contest constitutes entrant’s consent to the publication of his or her name and image in any media for any commercial or promotional purpose, without limitation or further compensation.
No confidential relationship is established by any entrant and the Sponsors as a result of entering the Contest. None of the information submitted by the entrant will be treated as trade secrets, confidential information or as protected data under any obligation. No patent, copyright or other intellectual property rights or licenses are granted to any Contest components supplied by the Sponsors to the potential entrants. Potential entrants do not receive by way of or under the Contest any intellectual property or other rights in any copyrights, patents, trademarks, trade names, technology, trade secrets or know-how of either the Sponsor or any third party,
9. General Terms: Incomplete entries shall be void. In the event of any dispute concerning the identity of any Internet Entrant, the Entry will be deemed submitted by the natural person who is the authorized holder of the transmitting e-mail account. Sponsors will not share or distribute or sell entries to third parties. By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements. No mechanically reproduced, software-generated or other automated multiple entries are permitted. All entries become the property of the Sponsors and will not be returned. Entry materials that have been tampered with or altered are void. The Sponsors, in their sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Web Site or is otherwise in violation of the Official Rules. Any questions regarding the number of entries submitted shall be determined by the Sponsors in their sole, reasonable discretion, and Sponsors reserve the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. Sponsors are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in the Contest. In the event this Contest is compromised for any reason (including computer virus, tampering, bugs, computer malfunction, fraud, unauthorized intervention or other causes beyond the control of the Contest Sponsors) which, in the sole opinion of Sponsors, corrupts or impairs the administration, security, fairness or proper play of the Contest, Sponsors reserve the right in their sole discretion to suspend, modify or terminate the Contest. Sponsors are not responsible if the Contest cannot be implemented or prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. All federal, state, local and municipal laws and regulations apply.
10. Disputes: Each Entrant agrees to release, defend, indemnify and hold harmless the Sponsors, those working on their behalf, and each of their respective officers, directors, representatives, employees, agents, successors and assigns, from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way relate to any Entrant’s participation in this Promotion, Sponsors’ use of the Entry or the awarding, acceptance, use or misuse of any Prize. Any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, shall be resolved individually, without resort to any form of class action. This Promotion shall be governed by, and construed in accordance with, the laws of the State of Illinois, regardless of principles of conflicts of laws that may require the application of the laws of another jurisdiction. Any action or litigation concerning this Agreement shall take place exclusively in the federal or state courts sitting in Lake County, Illinois, and each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each Entrant agrees to service of process by mail or other method acceptable under the laws of the State of lllinois. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
11. Administrator: Ageless-North Shore, attn Don Shearn, 1256 Forest Ave., Highland Park, IL 60035 All decisions of the Sponsors, Contest Administrator and the Judges shall regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsors will not be responsible for typographical, printing of the offer, administration of the Contest, the announcement of the prizes or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
12. Winners’ List: The name of the winners may be obtained by mailing a self-addressed, stamped envelope to Resolution Contest, Ageless-North Shore, attn Don Shearn, 1256 Forest Ave., Highland Park, IL 60035
